For example, under Massachusetts Lead Paint Law, if a child under 6 moves into a rental property the owner is responsible for making sure they check for lead and for de-leading if lead is present. Boston rental owners cannot refuse to rent to families with children to avoid disclosing information on the presence of lead paint. Additionally, rental owners cannot refuse to renew a pregnant woman?s lease or a family with young children?s lease because a unit may contain lead.

It seems that there is some conflicting information regarding rental owners that reside in one unit of their two-family homes. According to Chapter 151B, the state anti-discrimination law states that owner-occupied two-family homes are exempt from being held accountable for discriminating against children. Yet, there isn?t an exemption like this in regards to the lead paint law. So it seems that if a child is born while a family rents an owner-occupied 2-family, it has to be de-leaded.
